This is Session 2 out of 2 in the Administration of Government Contracts Virtual Course
Now that you've been awarded a federal government contract, government and contractor team members’ focus shift to administering that contract in a way that ensures that the contractor performs the requirements and delivers a usable end item or service into the hands of the end user in a timely and efficient manner.
Many issues and problems surface quickly during the contract administration phase. Both government and contractor personnel need to understand their rights and obligations under the contract and how to approach difficult situations and resolve problems to the mutual benefit of all parties to ensure that the end-users’ needs are satisfied in a timely and cost-effective manner. This specialized virtual course covers critical post-award contract administration topical areas, including the applicable contract clauses and critical issues that routinely confront the parties during contract performance.
The course is designed to stimulate critical thinking and discussion on commonly encountered contract administration issues. The application of certain key clauses and recurring issues that arise during the contract will be emphasized throughout to reinforce the importance of contract administration to successful performance and compliance.
What you will learn:
This workshop is designed to explain the legal and regulatory underpinnings of federal government contract administration by addressing all aspects of effective contract administration from initial award through contract closeout. It will provide you practical experience to keep contract performance on track by alerting you to common pitfalls encountered throughout performance of a federal government contract. The workshop will also discuss the parties’ rights and obligations under various contract clauses if an issue does arise during performance.
Learning Objectives: This is a student-centered course designed to teach you the basics through lecture to include:
What contract administration consists of, as well as the roles of various contracting personnel and their corresponding authority
The basic rules relating to cost accounting & reimbursement of costs under the FAR’s Cost Principles & Cost Accounting Standards
Subcontract placement, administration and flowdown provisions
Government Property used or acquired in performance of a contract
Effective management of changes, modifications and options
Production, performance, and schedules monitoring, addressing the effect of delays, disruption, and suspensions of work
The parties’ rights and obligations during the quality assurance process
Contract payments and financing
Contract terminations
Requests for Equitable Adjustment, formal claims and the procedures for resolving disputes related to contract performance
Contract close outs

About Our Experts
Brian A. Darst
Attorney, Odin, Feldman & Pittleman
Mr. Darst specializes in legal matters involving Government construction and service contract law and has extensive experience in the areas of contract formation and administration issues, bid protests, claims preparation and litigation, internal investigations, voluntary disclosures, procurement fraud investigations, various suspension and debarment proceedings, matters related to Small Business Administration, and other issues involving the award and administration of federal and state government contracts. Mr. Darst has represented clients in various matters before the Government Accountability Office, the Postal Service, Armed Services, and General Services Administration Boards of Contract Appeals, the Court of Federal Claims, the Small Business Office of Hearing and Appeals, and various agency-level proceedings. Mr. Darst's practice includes assisting clients with matters related to the sale and acquisition of firms involved in Government contracting, software licensing issues, other corporate governance matters, and civil litigation in Virginia and District of Columbia.
Mr. Darst is admitted to practice in the District of Columbia, Virginia, and West Virginia. He is admitted to practice before the United States Supreme Court, the United States Court of Federal Claims, the Court of Appeals for the Fourth Circuit, and the United States District Courts for the Eastern District of Virginia and the Southern District of West Virginia.
Mr. Darst earned his B.A. from Marshall University and a J.D. from West Virginia University. After graduating from law school, Mr. Darst worked as an attorney with the United States Navy's Office of General Counsel and represented the Navy in matters involving the acquisition and administration of service and supply contracts for the Naval Sea Systems Command.
