CMMC is Almost Here. Are You Ready?
After years of delays, the proposed Cybersecurity Maturity Model Certification (CMMC) Program Rule (32 CFR) is now expected to become a final, published rule by the end of 2024. For Defense contractors, this means that official CMMC audits can begin taking place after that. The enforcement rule for CMMC (48 CFR) is expected to become final sometime in 2025 and appear in DoD contracts in a phased approach. CMMC certification will become a prerequisite for contract award eligibility, and failure to achieve certification may result in ineligibility to bid and win contract awards. To achieve CMMC Level 2 certification (expected to be the most common), DoD contractors must both implement controls and requirements across their in-office systems, and require their cloud service providers that handle sensitive CUI to demonstrate FedRAMP Moderate equivalence. Building on the first session, we will examine how the applicable laws and regulations and evolving NIST standards impact Federal IT acquisitions and the provision of cloud services. We will also discuss cloud computing best practices, threat management considerations, and other practical application of this guidance in the context of cloud computing. Finally, we will examine the Federal Risk and Authorization Management Program ("FedRAMP") and its impact on cloud service providers. Learning Objectives: By the end of this session, students will be familiar with the laws and regulations governing cloud computing in Federal acquisitions. Students will also be familiar with the various NIST publications applicable to cloud computing, and will understand the cybersecurity framework designed by those publications. In this session, we will define cybersecurity foundations and explain why cybersecurity matters. We will discuss the type of information that must be protected, and the key governing bodies tasked with implementing the patchwork of laws and regulations addressing cybersecurity requirements. We will examine the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) clauses governing cybersecurity, as well as certain publications of the National Institute of Standards and Technology (NIST), with particular focus on NIST Special Publication (SP) 800-171, Protecting Controlled Unclassified Information in Nonfederal Systems and Organizations. Learning Objectives: By the end of this session, students will understand the importance of cybersecurity and how it impacts their organization. They will be familiar with the basic laws and regulations governing their cybersecurity compliance obligations, as well as the Federal contract clauses and standards implementing those obligations.
