Arguably an OTA allows the USG to contract faster without all the baggage of a traditional FAR based contract. In theory an OTA is a blank piece of paper that the USG and a contractor may negotiate the terms of the resulting Agreement (note the use of the term "Agreement" vs "Contract." The term "Contract" is defined in the FAR as a procurement contract.) But as anyone who negotiates contracts knows, there are always sticky clauses. This session will cover some of those sticky clauses. This session will cover what determines an item or service to be commercial and how to effectively support price reasonableness.
