    Kevin has significant experience litigating bid protests and tailors each bid protest strategy to the case, which has led to victories in agency-level, GAO, Court of Federal Claims and Federal Circuit protests. After award, Kevin has helped contractors respond to performance issues, defend against terminations and assert claims against the government. He has helped file scores of requests for equitable adjustments and helped several clients negotiate terminations for default into terminations for convenience. When agreement cannot be reached, he has extensive experience litigating such matters before the Court of Federal Claims, Civilian Board of Contract Appeals and the Armed Services Board of Contract Appeals.

    As a full-service government contracts attorney, Kevin helps companies build the necessary systems and infrastructure to ensure success. Kevin has also been called on to conduct internal investigations when questions are raised about the adequacy of a company’s existing compliance systems. Beyond merely advising clients on their obligations, Kevin has presented webinars on compliance with DOD’s cybersecurity requirements and the development of its Cybersecurity Maturity Model Certification (“CMMC”) rule as well as the more recent analogs from other federal agencies, like the Department of Veterans Affairs and Department of Homeland Security. He has represented clients in connection with their reporting obligations after data breaches and helped investigate cybersecurity and data handling practices.

    Kevin also counsels companies on the Freedom of Information Act (FOIA). He has helped scores of clients file records requests and works with the agency to ensure prompt and complete responses. Kevin has litigated many FOIA cases on both sides. He is a fierce advocate for companies battling the government for records and has used this aggressive approach in parallel to companies involved in or anticipating disputes with the government, such as possible False Claims Act matters or potential claims. These tactics allow companies to build their arguments and affirmative defenses earlier in the litigation process. On the other hand, Kevin has defended companies whose information is being sought. He has successfully intervened in a Ninth Circuit appeal on behalf of a biotechnology trade association and in a district court case for another technology company—in both cases preventing the information from being disclosed. He has also worked behind the scenes with the government to support its case to withhold certain contractor records and defend his client’s interest without becoming a party to the litigation.

    In addition, Kevin advises clients on complex attorney-client privilege matters, including the structuring of cross-border investigations to preserve the privilege for a large technology company, ability to assert privilege over forensic investigations accompanying data breaches and the organization of the legal department at a Fortune 10 company.   • Jeremy Becker Welts

    Jeremy Welts began the practice of law following graduation from William & Mary Law School in 1986. He initially worked as an associate attorney in commercial litigation for a law firm in New England until 1989, when he was hired by NASA Langley Research Center as an Attorney Advisor. At NASA Langley, his work included advising on general law issues (procurement, construction, FOIA, tort, and fraud) serving as counsel to source evaluation boards, source selection officials, negotiating Space Act Agreements, and litigation counsel in procurement- related activities and tort defense.

    Jeremy left NASA in 1995 to join the department of Navy Office of General Counsel as a Senior Trial
    Attorney. While at Navy, he served as a trial attorney with the joint Department of Navy/Department of Justice A-12 Litigation Team.

    Following his time on the A-12 Litigation Team, Jeremy was appointed Senior Assistant General Counsel with the U. S. General Services Administration (GSA), beginning in 1998. He served primarily in the Real property Division, where he analyzed and defended construction and lease-related claims and provided counsel to high-profile ongoing construction projects and Agency Senior Management. During his tenure at GSA, Jeremy served as lead counsel on 51 cases with claims totaling overall $610,683,384. Additionally, he designed and implemented a pilot program to provide risk management support for ongoing major construction projects.

    In 2006, Jeremy joined the nationally-ranked law firm Bradley Arant Boult Cummings, LLP, as a Senior Attorney, where he provided direct consultation, analysis, training in government contracting, and assistance for clients and counsel relating to wide range of government procurement and construction issues. He also provided legal and factual analysis, strategic planning, and legal writing to firm counsel for the presentation and resolution of federal contractor claims before agencies, boards of contract appeals, and federal courts.

    From January 2010 until his retirement in January 2014, Jeremy served as Assistant District Counsel for the Middle East District of the U.S. Army Corps of Engineers. He was responsible for assisting the Corps in successfully awarding and administering construction contracts throughout the Middle East. During his time at the Corps, he was a key player in the solicitation, evaluation, source selection and awarding of a $3.8 billion multiple award task order program serving construction efforts throughout the entire Middle East. While at the Middle East District, he was awarded the Superior Civilian Service Award Medal twice and was recognized as the Attorney of the Year for both 2011 and 2012.

    Throughout his Federal career Jeremy provided training within his various agencies in all aspects of Federal contracting, presenting workshops and training sessions on such subjects as Negotiations; FAR Workshops; Source Selection; Construction Contracting, and Contract Management. In 2011 he joined the faculty of Federal Publications Seminars and has served primarily as an in-house trainer for them in both government and industry.   • David Berteau

    Mr. Berteau became the President and Chief Executive Officer of the Professional Services Council (PSC) on March 28, 2016. Prior to PSC, Mr. Berteau was confirmed in December 2014 as the Assistant Secretary of Defense for Logistics and Materiel Readiness.     Kirk A. Foster is an Assistant General Counsel and the Director of Compliance and Privacy for Huntington Ingalls Industries (HII) Mission
    Technologies. In this capacity, he advises the President and senior leaders of HII Mission Technologies on compliance and legal matters,
    and supports the HII Mission Technologies business operations counsel and compliance managers on legal, regulatory, and strategic issues. He also supports the HII Mission Technologies Chief Information Officer on cyber and technology matters.

    Mr. David (Dave) Freeman is recently retired, closing out a what proved to be a three-track professional career. He served 23 years as an Army officer, initially starting out as a Signal Corps officer supporting the operational testing of new weapons platforms. Following his acceptance of an Army scholarship in the Funded Legal Education Program and the completion of his legal studies, Mr. Freeman completed his military career as a Lieutenant Colonel in the U.S. Army Judge Advocate General's Corps, working assignments both in the field and in buying commands, primarily as a Contract and Fiscal Law Attorney. He also served in a legal branch chief in the 1st Infantry Division during Desert Shield/Desert Storm, and later as a Deputy General Counsel in a DoD agency in Crystal City, Virginia. From the military, Mr. Freeman spent a number of years as an in-house counsel for several defense industry companies, lastly as the Deputy General Counsel for General Dynamics Land Systems. Finally, Mr. Freeman worked several years as a Department of the Army civilian supporting the National Training Center and Fort Irwin, California, where he had once served as a Major.

    Mr. Lalonde was appointed panelist on the fourth and fifth dispute resolution panels created under the Agreement on Internal Trade (now the Canadian Free Trade Agreement).
