Overview

The Foreign Corrupt Practices Act -- the U.S. law that prohibits the bribery of foreign public officials -- has been a major enforcement priority of the U.S. Department of Justice. Reports indicate that there are currently dozens of active government investigations and there have been several criminal settlements exceeding $100 million. The number of individual criminal prosecutions has also risen.

In addition, the U.S. Security and Exchange Commission, which enforces civil aspects of the FCPA related to issuers of securities in the U.S., increased its enforcement efforts. Finally, a number of other countries have developed -- and are investigating and enforcing -- potential allegations of their own, local anti-corruption laws so companies and individuals may find themselves the subject of overlapping investigations.

This seminar will cover four important topics relevant to the FCPA:
1) Background and history of the statute
2) Elements of a compliance program
3) Lessons learned from recent enforcement actions
4) Multijurisdictional aspects of investigations and enforcement
The instructors are all experienced, "boots on the ground" practitioners who have conducted FCPA investigations in numerous locales. This program should be of interest to any company engaging in foreign operations.
